How to check Company or LLP name availability in India


In this article, I will explain how to choose a name for your business in India and how to check if the name you like are already taken by someone else.

Any registered LLP or Company should have a name approved by Ministry of Corporate Affairs (MCA). When you incorporate, you can submit your preferred business names. If the names you suggested are already used or reserved by someone else, your application may be denied. Before you apply submit your documents to register a company or LLP, it is strongly recommended you check if the name you suggest are already taken by someone else.



You can check if a company with your preferred name already exists in India by visiting the Ministry of Corporate Affairs official website http://mca.gov.in/DCAPortalWeb/dca/MyMCALogin.do?method=setDefaultProperty&mode=16

Type the first few letters of your preferred business name and search for it. It will show the list of companies and LLPs with those names.

Name guidelines for LLPs and Companies in India


There are several guidelines in choosing a name for a company. Some of them are explained below.

1. You cannot choose the name of an existing LLP or Company.

2. You cannot choose a name very similar or misleading to an existing entity. For example, If there is a company called "J P Technologies", you may not be able to choose the name "Jay Pee Technologies".

3. You cannot use certain words like India, National, Central, State, Government etc in the business name since that will confuse people with the government organizations.

4. Certain terms like Bank, Insurance, Advocates etc can be used in the business names only after prior approval from relevant authorities.

5. Business registered as LLP should include the term "Limited Liability Partnership"or "LLP" at the end of the name.

6. Companies should include "Private Limited" or "Public Limited" in the name, whichever is applicable. An abbreviation "Ltd" can be used in place of "Limited".

7. A registered trade mark cannot be used in the business name without the permission of the trade mark owner.

8. The proposed name should not be offensive to any section of the people.
